Premises Liability
Premises liability is the law that holds a property owner responsible for injuries suffered by others who set foot on that property. In most cases, the injured party must prove that the premises owner knew of the danger or hazard that caused the injury but failed to correct it in a reasonable timeframe. These cases often involve a slip and fall injury.

Among the property hazards and building code violations that can cause severe injuries are the following:

  • Rickety handrails or no handrails at all on stairways
  • Wet floors with no warning signs
  • Uneven carpeting or slippery throw rugs
  • Uneven or icy sidewalks
  • Merchandise falling from store shelves
  • A broken or hidden step

The key to winning a premises liability claim is to establish that the property owner was negligent or careless in maintaining their property. It is also important to establish that the victim was welcomed or invited onto the property as trespassing is often a bar to an injury claim.
